SELF-INSTALLED SOFTWARE POLICY

  1. INTRODUCTION

Nubius Solutions provides customers with full administrative access to their hosting environments, allowing them to install software they have developed or obtained from third-party providers. However, the installation and use of such software are subject to the Nubius Solutions Acceptable Use Policy (AUP), which prohibits software or services that pose a risk to the hosting environment. Additionally, customers must adhere to the following terms regarding support, security, and liability for any self-installed software.

 

  1. SUPPORT FOR SELF-INSTALLED SOFTWARE
  • Nubius Solutions does not provide support for software that customers install independently.
  • Customers are solely responsible for the installation, configuration, maintenance, and troubleshooting of self-installed software.
  • If self-installed software causes service degradation, security vulnerabilities, or operational issues, Nubius Solutions may offer assistance on a billable basis, subject to prior agreement.
  • If an issue resulting from self-installed software affects the hosting environment, customers may be required to pay for any remediation efforts necessary to restore service functionality.

 

  1. SECURITY & VULNERABILITIES OF SELF-INSTALLED SOFTWARE
  • Software installed by customers may contain unpatched vulnerabilities that could be exploited by malicious actors.
  • Customers are responsible for regularly updating and securing all self-installed software to mitigate security risks.
  • Vulnerable software may result in:
    • Service outages affecting the customer’s own environment.
    • Disruptions to other users in the Nubius Solutions infrastructure.
    • Network abuse or exploitation affecting external Internet users.
  • In cases where a security breach originating from self-installed software impacts Nubius Solutions’ services or customers, Nubius Solutions reserves the right to:
    • Suspend or terminate the affected service until security measures are implemented.
    • Charge the customer for necessary remediation efforts, including restoring services or mitigating security threats.

 

  1. LIABILITY & SERVICE IMPACT
  • Customers assume full responsibility for any security, operational, or performance issues arising from self-installed software.
  • If Nubius Solutions detects a security breach or service disruption linked to self-installed software, we may take the following actions:
    • Issue a formal notice requiring corrective action within a specified timeframe.
    • Isolate or suspend the affected service to protect other customers and infrastructure stability.
    • Terminate the service if the customer fails to address the issue in a timely manner.
  • Any costs incurred by Nubius Solutions to mitigate issues caused by self-installed software, including security breaches and resource overuse, may be billed to the customer.

 

  1. COMPLIANCE & ACCEPTABLE USE
  • Customers must ensure that self-installed software complies with all applicable laws and regulations.
  • The use of software that facilitates spamming, illegal activities, or unauthorized resource usage is strictly prohibited.
  • Nubius Solutions reserves the right to audit installed software for security and compliance reasons.
